[chirp_users] Are Baofeng & Wouxun FCC compliant?
Recently here in Oz, there have been a number of Chinese radios use by Marine Rescue people, confiscated by ACMA officers claiming interference potential and the usual BS. ACMA in Oz is similar to FCC in the US.
I notice my Wouxun complies with FCC part 15 but cannot find a similar statement in the Baofeng manual.
I believe as amateurs (full calls) we are allowed to build our own gear so I assume we, the licensed operator, are responsible for complying with licensing requirements and are not limited to commercial, type approved, expensive equipment.
I would assume Australian laws would be similar to US laws in this respect.
How would this issue affect non Ham users, i.e. CB, Commercial, Civil Defence, Volunteer Fire & Rescue organisations etc? -- 73 Bob, *VK2BYF *
The Baofeng radios do have an FCC label on the radio. AB1ST

Hi Bob,
I own several Wouxun radios and all of them will transmit out of band. Police, fire, air traffic, you name it. During an emergency, anything is allowed, so I'm actually glad to have them. But it's also possible to buy radios here (depends on where you buy them) that are only in-band radios for ham. If you go to places in Canada, you can get the other kind (where I got mine), and they still all have the FCC compliant label on them.

In the USA home made equipment and commercially manufactured equipment are totally different things as far as the FCC is concerned. The FCC has compliance requirements for all equipment. For amateur use in the USA all commercially manufactured equipment must have at minimum a Part 15 approval for the receiver section. Since Part 90 (or any other type acceptance) automatically includes this then we can use these radios. Home made equipment requires no FCC approval whatsoever. since amateurs are considered to have skills to apply proper engineering practices. In Australia I have heard the ACMA is VERY thorough in its enforcement of unapproved equipment. I have heard of Australian amateurs having their Baofengs Wouxuns etc confiscated in violation. You need to see what is or is not approved there. Remember Australia actually enforces their communications laws so the Americans you hear saying they can do this or that may not be good advice for you. Of course the Aus. CBer using Baofengs and such is pretty much screwed since the ACMA will be onto them in droves. My apologies for weird sentences. My kids use this laptop and gunked it up so the comma key doesn't work

Not sure what this has to do with the subject, but in the USA Type Acceptance is not needed when building or modifying equipment for the ham bands for use by licensed amateurs.
To address the subject question, it depends on the model and programming. Some models are type accepted by the FCC for Part 90 use. To meet the Part 90 spec, the keypad frequency entry must be disabled. I have a Wouxun that meets both criteria.

There was a day here in the states when radio equipment had to be setup/blocked for just amateur band use only. Most all of the radios in recent years can be cracked for full band spread use easily, user beware.
Yes amateurs can build there on rigs/radio equipment here in the states, and they do have to meet all the specs for use in the amateur bands laid down by the FCC, but the amateur bands "only". You can purchase commercial equipment, such as Motorola, which can be use with in the amateur bands, but any use outside the amateur bands, unless authorized/licensed to, again user beware.

Remember in an "EMERGENCY" anything goes. You may use ANY FREQUENCY that you have access to. I had a ht that I provided to my parents in AZ. for them to carry and use when driving between their homes in Phoenix and Payson.
It was tuned to Department of Public Safety, Maricopa County Sheriff's Department and Gila County Sheriff's Department. They carried it for 15 years and used it many times to report traffic accidents, rock falls that closed the highway, Medical emergency's and one time to report the death of a DPS Officer when a bridge he was checking during a flood washed him and his car downstream on AZ 87 @ Sycamore creek during a flood in 1970 IIRC. After each use they notified the FCC Engineer of the use and why. No problems from FCC or any of the Department's involved.
