There was a day here in the states when radio equipment had to be setup/blocked for just amateur band use only. Most all of the radios in recent years can be cracked for full band spread use easily, user beware.
Yes amateurs can build there on rigs/radio equipment here in the states, and they do have to meet all the specs for use in the amateur bands laid down by the FCC, but the amateur bands "only". You can purchase commercial equipment, such as Motorola, which can be use with in the amateur bands, but any use outside the amateur bands, unless authorized/licensed to, again user beware.

Not sure what this has to do with the subject, but in the USA Type Acceptance is not needed when building or modifying equipment for the ham bands for use by licensed amateurs.
To address the subject question, it depends on the model and programming. Some models are type accepted by the FCC for Part 90 use. To meet the Part 90 spec, the keypad frequency entry must be disabled. I have a Wouxun that meets both criteria.
